Who Is Eligible for Social Security Disability Benefits?
If you have a recognized impairment, or combination of impairments which causes disability which leave you unable to pursue gainful employment for at least twelve months or beyond, you are eligible for Social Security disability benefits. You must have worked a certain period of time, and paid in Social Security taxes, in order to qualify for SSD, but if you do not qualify, you may be able to qualify for SSI benefits.
What do I do if my Claim Has Been Denied?
Many initial claims for Social Security benefits are denied. You still have options. After your initial denial, you can request a reconsideration of the decision. If the initial decision is upheld upon reconsideration, you will have to request a hearing before an administrative law judge. If still denied, you then can appeal your denial to the Appeals Council.
I do not have the money to hire a lawyer. How can I make sure I get the benefits I deserve?
An attorney's contract for representation before the Social Security Administration is controlled by regulation which provides that attorneys fee from your retroactive benefits must be the lesser of 25 percent or $6000 at the present time. This means you will not have to pay any attorneys fee until and unless we win your case.
